1. Agreement and operator
These Terms are an agreement between you and Growth Arc Network, LLC for your use of HostelPrice. By creating an account or using the service, you agree to these Terms. If you use HostelPrice for an organization, you confirm that you can bind that organization.
2. The service
HostelPrice is a rate-monitoring and decision-support service for independent hostels. It compares a property’s publicly bookable Hostelworld rates with a user-selected competitor set across upcoming stay dates and may surface price position, restrictions, scarcity, sellouts, and rank changes. Alerts may be offered by WhatsApp, email, or other stated channels.
3. Eligibility and account responsibilities
You must be at least 18 and legally able to enter this agreement. Provide accurate information, keep sign-in credentials secure, maintain access to your contact channels, and promptly tell us about suspected unauthorized use. You are responsible for activity under your account and for choosing properties and competitors you are authorized to manage.
4. Acceptable use
You must not:
- use HostelPrice unlawfully, deceptively, or to violate another person’s rights;
- probe, disrupt, overload, bypass, or reverse engineer the service or its security controls;
- resell access, share an account outside your organization, or use automated means except through interfaces we expressly provide;
- use the service to coordinate unlawful pricing, misrepresent availability, or send unlawful or unwanted messages; or
- submit data you do not have the right to use.
5. Monitoring limits and data accuracy
HostelPrice observes public third-party information at intervals; it is not a booking engine or a real-time guarantee. Rates, availability, restrictions, rank, reviews, and other signals may be delayed, incomplete, unavailable, or incorrect because of source changes, network limits, classification, currency boundaries, or other factors. Confirm important decisions in the source system. You remain responsible for pricing, inventory, distribution, and legal compliance.
6. Third-party services and independence
Hostelworld supplies the public market context observed by the service but is not a party to these Terms. HostelPrice is not affiliated with, sponsored by, or endorsed by Hostelworld, Meta, or WhatsApp. Their names and services belong to their respective owners and their own terms may apply to your use of them.
7. Alerts and WhatsApp consent
Alerts are informational and may be delayed, duplicated, filtered, or not delivered. By submitting and verifying a WhatsApp number, you ask HostelPrice to send service and rate alerts to that number through the Meta WhatsApp Cloud API. Message and data charges may apply. Reply STOP to opt out of WhatsApp messages; this does not cancel your account or any paid subscription. You can request deletion separately through the Data Deletion page.
8. Paid plans and billing
If paid access is offered to you, the price, billing interval, property quantity, trial (if any), taxes, and renewal terms shown at checkout form part of these Terms. You authorize the stated payment provider to charge the selected method. Unless the checkout states otherwise, subscriptions renew until canceled. Cancellation takes effect as shown in your account or checkout terms and does not create a refund right except where required by law or expressly stated.
9. Intellectual property and feedback
HostelPrice and its software, design, analysis methods, branding, and original content are owned by the operator or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes while your account is active. You keep rights in information you submit and allow us to use it to provide, secure, and improve the service. Feedback may be used without restriction or payment.
10. Suspension and termination
You may stop using HostelPrice and cancel as provided in the service. We may restrict or suspend access for non-payment, security risk, unlawful or abusive use, material breach, or to protect the service and others. Where practical, we will give notice and a chance to fix the issue. Terms that by their nature should continue — including payment obligations, intellectual property, disclaimers, and liability limits — survive termination.
11. Disclaimers
To the extent permitted by law, HostelPrice is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy. Nothing in these Terms excludes consumer rights or other warranties that cannot legally be excluded.
12. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive loss, or for lost profit, revenue, goodwill, or data. HostelPrice’s total liability arising from the service will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be heard in the state and federal courts located in Delaware, except where mandatory law gives you the right to bring a claim elsewhere. Before filing a formal claim, contact us so we can try to resolve the issue informally.
